Juventus Capital Gains Trial: Defence Seeks Annulment of Indictment

A new hearing in the trial against Juventus and several of its former executives took place yesterday in Rome. The case, cantered on alleged capital gains irregularities and salary manoeuvres during the Covid-19 pandemic, involves high-profile figures such as Andrea Agnelli, Pavel Nedved, Maurizio Arrivabene, and Fabio Paratici. The charges include market manipulation, obstruction of supervisory authorities, false invoicing to generate fictitious capital gains, and irregular interventions on players’ salaries.

La Stampa (via Calciomercato) The defence team, represented by lawyers Sangiorgio, Bellacosa, and Apa, has presented a motion to Judge Anna Maria Gavoni requesting the annulment of the indictment. This request is based on two formal defects identified by the defence:

  1. Issues surrounding the 2021 raids and seizure of digital material.

  2. Failure to properly select relevant case material, as among the 221 parties admitted to the civil trial, there are reportedly personal photos and medical records that may have violated the defendants’ rights to defense and personal privacy.

The defence argues that these procedural irregularities have compromised the integrity of the case and infringed upon the rights of the accused. This move represents a significant attempt to challenge the legal foundations of the prosecution’s case against Juventus and its former leadership.

Judge Gavoni is expected to rule on this request at the next hearing, scheduled for April 15th. This decision could have far-reaching implications for the progression of the trial and the future of one of Italian football’s most high-profile legal battles in recent years.
